Terms of Service

By creating an account or using Phemly you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service. Account acceptance requires checking a confirmation box during registration.

Phemly is a SaaS platform that monitors brand visibility across leading AI search engines. The platform provides AI search scanning, brand mention tracking, visibility scoring, sentiment analysis, technical audits, content recommendations, and competitive analysis.

You must provide accurate registration details and maintain the confidentiality of your credentials. You are responsible for all activities that occur under your account. Report any unauthorized access immediately to security@phemly.com.

The Service includes free and paid plans billed monthly or annually through Stripe. You may cancel anytime with continued access through the end of the billing period. Refunds are handled on a case-by-case basis within 14 days of purchase. Pricing changes require 30-day advance notice.

You may not use the Service for unlawful purposes, unauthorized access attempts, service interference, unauthorized data scraping, AI result manipulation, credential sharing, plan limit violations, or unauthorized automated tool access beyond the provided APIs.

Each subscription tier defines restrictions on scan frequency, monitored prompts, AI analysis requests, and content generation. Exceeding limits may trigger temporary service suspension until the next billing cycle.

You retain rights to your input data and account-specific scan results. Aggregated, anonymized insights derived from all users remain our property and may be used for product enhancement. You may export your data or delete your account at any time via Settings.

Phemly owns the Service, original content, features, algorithms, and functionality, protected by international copyright and trademark law. Names of third-party AI search engines and language models are trademarks of their respective owners.

The Service is provided "as is" and "as available" without warranties of any kind. We make no guarantees regarding AI scan accuracy, uninterrupted service availability, or consistency of visibility scores across different time periods. The Service's outputs are generated by third-party AI search engines and language models, may be inaccurate or incomplete, and do not constitute advice you should rely on exclusively. We reserve the right to change the AI search engines and models underlying the Service at any time.

Phemly disclaims liability for indirect, incidental, special, consequential, or punitive damages arising from Service use, including lost profits or business interruption. Phemly's total aggregate liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the claim. These limitations do not apply where liability cannot be excluded or limited under Czech law (in particular intent, gross negligence, and personal injury).

We reserve the right to modify or discontinue any Service component at any time. We will provide reasonable notice for material changes that affect your use of the Service.

Accounts may be terminated for violations of these Terms, immediately ceasing all usage rights. You may request a data export before termination.

We may modify these Terms at any time. We will send email notification of material changes at least 14 days prior to their effective date. Continued use of the Service indicates your acceptance of the revised Terms.

These Terms are governed by Czech Republic law. Disputes will be resolved through Czech competent courts.
